Lawful: Compliant with the laws of Sri Lanka and the jurisdiction in which you operate.

Respectful: Respectful of the rights, privacy, and property of others.

Appropriate: Consistent with the intended purpose of the services.

2.1 Illegal Content and Activities: Hosting, distributing, or linking to content that violates any applicable law. Facilitating illegal transactions, including the sale of controlled substances, counterfeit goods, or stolen property. Operating unauthorized gambling services.

2.2 Malicious Activities: Distributing malware, viruses, trojans, worms, or any other malicious software. Conducting phishing attacks or creating deceptive websites designed to steal credentials. Launching denial-of-service (DoS/DDoS) attacks or participating in botnets. Unauthorized scanning, probing, or penetration testing of networks or systems. Exploiting security vulnerabilities in Nyxzie's or any third party's systems.

2.3 Spam and Unsolicited Communications: Sending unsolicited bulk email (spam) from or through Nyxzie services. Using Nyxzie domains for email spoofing or header forgery. Harvesting email addresses or personal information from the internet.

2.4 Intellectual Property Violations: Hosting content that infringes copyrights, trademarks, patents, or trade secrets. Registering domain names in bad faith to profit from the trademark of another party (cybersquatting). Operating counterfeit online stores.

2.5 Harmful Content: Hosting or distributing child sexual abuse material (CSAM). Reports will be immediately forwarded to the relevant law enforcement authorities. Hosting content that promotes terrorism or violent extremism. Hosting content designed to harass, threaten, or intimidate individuals.

2.6 Resource Abuse: Consuming excessive server resources in a manner that degrades service for other customers (on shared hosting plans). Running cryptocurrency mining software on any Nyxzie hosting tier. Using services as a general-purpose file storage or backup repository beyond the intended purpose. Running IRC bots, traffic proxies, or Tor exit/relay nodes on Nyxzie infrastructure. Reselling allocated hosting resources to third parties without an explicit Nyxzie reseller agreement.

3.1 Permitted Use: Hosting resources are provided for running websites, web applications, and associated server-side scripts. Resources must be used for their intended purpose and not repurposed for unrelated computing tasks.

3.2 Fair-Use Resource Limits: Shared hosting plans are subject to fair-use CPU and RAM thresholds. Sustained CPU usage above 25% of the allocated core for more than 90 consecutive seconds may result in automatic process throttling without prior notice. Disk space must not be used for storing large media archives, software distributions, or backups originating from external services. Inbound and outbound bandwidth is subject to plan limits. Excessive consumption may result in temporary throttling or a request to upgrade your plan.

3.3 Prohibited Server Activities: You may not: run cryptocurrency mining, coin minting, or any blockchain computation workload; operate IRC servers, traffic proxies, open HTTP/SOCKS proxies, Tor exit nodes, or anonymization relays; run automated bots, scrapers, or crawlers that place sustained load on Nyxzie infrastructure; host or distribute torrent files or operate P2P file-sharing services; execute long-running background processes not related to serving web traffic unless explicitly permitted; or operate reseller hosting services without a separate written reseller agreement.

3.4 Script & Application Responsibility: You are solely responsible for keeping all scripts, CMS installations (e.g., WordPress), plugins, and third-party libraries installed on your hosting account up-to-date and secure. Nyxzie is not liable for security incidents caused by outdated or vulnerable software installed by the customer.

3.5 Backup Responsibility: Nyxzie may perform infrastructure-level snapshots for disaster recovery purposes. These snapshots are not a substitute for your own backup strategy. You are responsible for maintaining independent backups of your website files and databases. Nyxzie does not guarantee the availability or restoration of any particular snapshot.

4.1 Permitted Use: Nyxzie business email mailboxes are provided for legitimate business correspondence associated with your registered domain. Mailboxes must not be used as a general-purpose email forwarding service or as an email relay for external systems.

4.2 Anti-Spam Obligations: You must not send unsolicited bulk email (spam) from any Nyxzie mailbox. All marketing or promotional emails sent from Nyxzie mailboxes must comply with applicable anti-spam laws (including CAN-SPAM, GDPR, and applicable Sri Lankan regulations) and must include a functional unsubscribe mechanism. Automated bulk sending must use a dedicated transactional email service (e.g., SMTP relay); using mailboxes directly for mass campaigns is prohibited.

4.3 Rate Limits: Outbound email is subject to per-mailbox rate limits. Exceeding these limits may result in temporary suspension of the mailbox's outbound sending capability. Nyxzie reserves the right to adjust rate limits at any time to protect platform deliverability and reputation.

4.4 Prohibited Email Activities: You may not use Nyxzie email services to: send email using forged headers, false sender identities, or spoofed addresses; harvest, collect, or sell email addresses obtained through Nyxzie services; operate automated spam pipelines, phishing campaigns, or credential-harvesting schemes; use a Nyxzie mailbox as an open relay or forwarding service for external spam; or send threatening, harassing, defamatory, or illegal content to any recipient.

4.5 Quota Enforcement: Mailboxes that reach their storage quota will enter a soft-bounce state for new inbound mail until storage is freed or the mailbox plan is upgraded. Nyxzie is not liable for lost email resulting from a full mailbox quota.

4.6 DNS Configuration Responsibility: You are responsible for correctly configuring the DNS records associated with your email service (MX, SPF, DKIM, DMARC). Nyxzie provides default DNS records for mailboxes provisioned under Nyxzie DNS, but you are responsible for verifying their accuracy, especially if using external DNS providers. Nyxzie is not liable for email delivery failures caused by incorrect or missing DNS records.

5.1 WHOIS Accuracy: You must ensure that all domain registration information (WHOIS data) is accurate and up-to-date at all times. Registry regulations require that inaccurate WHOIS data may result in domain suspension.

5.2 DNS Abuse: You may not use Nyxzie DNS services to: conduct DNS amplification attacks; set up wildcard DNS records for malicious purposes; or operate open DNS resolvers.

5.3 Nameserver Delegation: Delegation of your domain to Nyxzie Cloud nameservers is optional. You may use external DNS providers. If using external DNS, you are solely responsible for the accuracy and security of all DNS records, including those required for email delivery (MX, SPF, DKIM, DMARC). Nyxzie-managed DNS records are only provisioned and maintained for domains actively using Nyxzie nameservers.

5.4 Domain Abuse: Domains registered through Nyxzie must not be used for: fast-flux hosting (rapidly changing DNS records to avoid detection of malicious activity); domain generation algorithms (DGA) used by malware; or typosquatting (registering misspellings of popular domains for malicious purposes).

6.1 Investigation: Nyxzie reserves the right to investigate any suspected violation of this AUP. During an investigation, we may: temporarily suspend the affected service(s); examine server logs, traffic data, and hosted content; and cooperate with law enforcement if required.

6.2 Actions: Upon determining a violation, Nyxzie may, at its sole discretion: issue a warning with a deadline for corrective action; suspend the affected service(s) temporarily; terminate the affected service(s) permanently; remove or disable access to offending content; or report the activity to law enforcement.

6.3 No Refund: Services terminated due to AUP violations are not eligible for refund.

6.4 Repeat Offenders: Customers with repeated AUP violations may be permanently banned from all Nyxzie services.
