Terms of Service

Your Content: You own your data (images, text, product listings). Your profile and materials uploaded remain yours.

Nyxzie Platform: Nyxzie retains all rights to the underlying software, blueprints, source code, design algorithms, Phase-Shift technology, and the entire Nyxzie Augment Library (Core, Aura, Beacon). These technologies are proprietary and may not be reverse-engineered, reproduced, or redistributed.

No Code Export: You may export your data (CSV of products/orders) at any time. However, you may not export the website's source code, HTML structure, blueprints, or any Augment-powered features for self-hosting on other servers. The site must be hosted on Nyxzie infrastructure.

Billing Cycle: Subscription fees are billed in advance on a monthly or yearly basis as selected by you.

Non-Refundable: All payments are non-refundable unless otherwise required by law. There are no refunds for partial months of service, upgrade/downgrade refunds, or refunds for months unused with an open account.

Commission & Overage Fees: Certain plans (e.g., E-Commerce Starter) are subject to transaction fees, commissions, or sales volume caps as specified in your Plan Details. These are billed monthly.

Price Changes: We may change pricing with 30 days' notice. Continued use after the change implies acceptance.

Augment Taxonomy: Nyxzie Augments are classified into three tiers: (1) Core Augments (essential structural components like Bio, Contact, Gallery), (2) Aura Augments (premium visual effects like Flux Drift and business tools like Wire Chat), and (3) The Beacon Suite (advanced visibility intelligence like Prism Refraction).

Usage & Subscriptions: Core Augments are included with standard plans. Aura and Beacon Augments are premium features available via additional subscription or one-time purchase. Augments are billed according to their individual pricing and may have expiration dates.

Aura Augments (Flux & Wire): Aura Augments provide visual enhancements (Flux) and business tools (Wire). These features remain active only while the subscription is valid. Disabling an Aura Augment will hide its functionality from the live site immediately.

Beacon Focus: Beacon Focus is our AI-driven content calibration engine. It analyzes and optimizes your website's signal clarity to improve search resonance. The calibration results and recommendations are generated algorithmically and Nyxzie does not guarantee specific search engine rankings.

Beacon Prism (Refraction): Beacon Prism uses contextual refraction technology to generate unique entry points for your business across multiple locations and contexts. You acknowledge that: (a) Prism-generated content is derived from your provided data sources and business identity; (b) you are responsible for ensuring the accuracy of your source data; (c) Nyxzie does not guarantee indexing or ranking of refracted pages by any search engine; (d) the Pulse Control system regulates expansion rate to maintain organic growth patterns.

Nyxzie Pulse (Intelligence): Beacon Pulse is our privacy-first visitor intelligence system. It collects anonymized visitor data (page views, country, device type) using hashed identifiers that reset daily. Pulse does not use tracking cookies and does not share data with third parties. Detailed intelligence reports are available only to Pulse augment subscribers.

Service Description: Nyxzie Reminisce is a real-time event guestbook and media projection service provided as part of the Nyxzie Augment Ecosystem. It allows event guests to submit text messages, photographs, and video clips via a QR-code link, which the event operator may moderate, display on a projector/LED screen ("Projection Mode"), and spotlight individual entries using Director Mode.

Branding & Intellectual Property: All Nyxzie Reminisce branding elements (including but not limited to watermarks, brand text, animated footers, header badges, and icons) MUST remain visible and unmodified at all times across every guest-facing page, QR material, and Projection/Jumbotron screen. You may NOT remove, obscure, alter, or bypass branding through any method (CSS overrides, developer tools, extensions, physical covering, or otherwise). Tampering constitutes a material breach and will result in immediate service suspension and may lead to account termination without refund. Nyxzie reserves the right to programmatically verify branding presence and automatically suspend functionality if tampering is detected. This requirement applies to all Reminisce tiers.

Content Moderation Responsibility: The event operator ("you") is solely responsible for moderating all guest-submitted content before it is displayed publicly or on a projector. Nyxzie provides moderation tools (Approve / Reject / Delete) but does not pre-screen, filter, or assume liability for user-generated guest content. You must ensure that all displayed content complies with applicable laws, venue policies, and community standards.

Director Mode & Projection: Director Mode ("Push to Screen" / Spotlight) is a premium feature that allows you to select and push individual entries to a full-screen projector view. You acknowledge that: (a) the projector URL is publicly accessible and you are responsible for securing access; (b) Nyxzie is not liable for any disruption, technical failure, or content-related incident during live projection; (c) the Spotlight polling mechanism is provided on a best-effort basis and is not guaranteed to be instantaneous.

Guest Data & Privacy: Guest submissions (names, messages, photos, videos) are stored on Nyxzie infrastructure for the duration of your active subscription. You are the data controller for all guest data collected through your Reminisce guestbook. You must: (a) inform event guests that their submissions will be displayed publicly and stored digitally; (b) obtain any necessary consent required under applicable data protection laws (including GDPR, CCPA, or PDPA); (c) not use guest data for purposes beyond the event guestbook without separate guest consent. Upon account termination or deactivation, all guest data will be permanently deleted within 30 days.

Media Uploads & Storage: Guest-uploaded media (photos and videos) are subject to storage limits based on your Reminisce tier. Nyxzie does not claim ownership of guest-uploaded media. By uploading media through the guestbook, the guest grants you (the event operator) a limited, non-exclusive license to display the media at the event and through the Reminisce dashboard. You may not redistribute, sell, or commercially exploit guest media without separate consent from the guest.

Prohibited Uses: You may NOT use the Reminisce service to: (a) collect personal data under false pretenses; (b) display or solicit illegal, obscene, or harmful content; (c) impersonate another business, individual, or event; (d) use guestbooks as a general-purpose file hosting or content distribution service; (e) allow automated bot submissions or bulk uploads that bypass the intended guest experience; (f) use Reminisce for surveillance, unauthorized recording, or any purpose that violates guest privacy.

Service Tiers: Reminisce is available in Free, Pro, and Enterprise tiers. Feature availability (including Director Mode, Jumbotron Display, media upload limits, and entry volume caps) varies by tier. Nyxzie reserves the right to rate-limit or throttle Free-tier guestbooks that exceed fair-use thresholds.

QR Code Usage & Security: The Reminisce QR Code links directly to the official guest submission page hosted on Nyxzie infrastructure. You may NOT alter, redirect, proxy, or replace the QR Code URL to point to any non-Nyxzie destination, or create derivative QR Codes linking to unauthorized versions of the submission page. The QR Code URL remains the property of Nyxzie and may be deactivated upon service expiration or termination. Nyxzie reserves the right to embed tracking parameters within QR Code URLs for abuse detection.

Projector Toggle & Resource Management: The Projector On/Off Toggle allows event operators to control the live status of the Projection screen. Nyxzie may automatically reduce or pause projector refresh activity when set to "Off" (Standby) or when resource-management safeguards are applied. You acknowledge that: (a) the projector status is persisted and will survive server restarts; (b) toggling "Off" does not delete any guestbook entries or settings; (c) standby states may retain lightweight polling for state detection and these safeguards cannot be disabled; (d) Nyxzie may adjust polling cadence or refresh frequency without notice for performance or infrastructure protection; (e) abuse of the toggle API may result in rate-limiting or service termination.

Termination: You may cancel your account at any time. We reserve the right to suspend or terminate your account immediately and without notice if you violate these Terms, specifically regarding the sale of illegal goods, non-payment of fees, or abuse of Nyxzie proprietary technology (including Phase-Shift and the Beacon/Aura suites). Upon termination, your right to use the Service ceases immediately. All Augment-powered features (including Prism refractions) will be deactivated. You may export your source data before account deletion.

Domain Names: If Nyxzie registered a custom domain on your behalf as part of a promotional offer ("Free Domain"), the domain ownership remains with Nyxzie for the first 12 months. If you wish to transfer the domain before this period, a transfer fee of LKR 5,000 applies.
